Brazil: Extension of the validity of the obligations dealing with Psychosocial Risks in NR-1

The Ministry of Labor and Employment (MTE) published today (May 16) MTE Ordinance No. 765/2025, extending until May 25, 2026 the entry into force of chapter 1.5 of Regulatory Standard No. 01 (NR-1), which deals with the management of Psychosocial Risks at work.
The decision changes a previous guidance (released on April 24) by the MTE itself, which stipulated that the new rules should come into force in May 2025, initially with an educational approach and without the application of penalties in the first year.
The Ordinance published today postpones the obligation to manage Work-Related Psychosocial Risk Factors (FRPRT) by one year, giving companies more time to adapt.
Although labor inspection of chapter 1.5 of NR-1 will not take place at this time, it is worth remembering that the provisions of NR-17, NR-33 and other NRs that deal with the subject must continue to be observed. In other words, companies are still subject to inspection, although not because of NR-1’s requirements regarding Occupational Risk Management.
Recommendation
Despite the postponement, it is recommended that organizations do not wait until 2026 to adapt and use the additional period to:
- Review internal procedures and practices;
- Evaluate the work environment, as a way of defining the inclusion of Psychosocial Risk Factors (“FRPs”) in Risk Management Programs (“PGR”);
- Clarifying doubts and ensuring gradual compliance;
- Promoting educational activities with leaders and everyone in the organization.
