New MMA Ordinances reinforce rules and expand the scope of reverse logistics in Brazil

The rules maintain targets, expand the scope of materials, and detail procedures for the accreditation of entities and verifiers.

On January 5, 2026, Ordinance GM/MMA No. 1,560 was published, establishing guidelines for reverse logistics systems for electronic products and their components for domestic use, as provided for in Decree No. 10,240/2020.

The rule maintains, for the year 2026, the targets set for 2025 in Annex II of the Phase 2 Implementation Schedule, until new regulations are issued, ensuring the continuity of actions aimed at the proper management of this waste.

Among the main aspects of Annex II of Decree No. 10,240, the target for environmentally appropriate collection and disposal stands out, set at 17% of the total weight of household electronic products sold in the domestic market. In addition, the territorial expansion schedule set forth in Annex II remains unchanged, consolidating the system’s national coverage with service to 400 municipalities by the end of Phase 2.

On the same date, Ordinance GM/MMA No. 1,561 was published, amending Ordinance No. 1,102/2024 to regulate provisions of Decree No. 11,413/2023, defining criteria for the qualification of management entities and parameters for their performance in reverse logistics systems for packaging in general.

The ordinance also amends Ordinance GM/MMA No. 1,117/2024 to establish criteria for the qualification of result verifiers and launch the first public call for registration of interested legal entities. Among the main changes is the inclusion of new materials in the scope of reverse logistics for packaging, covering paper and cardboard (including long-life carton packaging), metals (aluminum, steel, other metals or metal alloys), and glass.

The annual periods for new qualifications were also defined: from March 1 to 31 for management entities and from April 1 to 30 for result verifiers. The public notices will be published in the Federal Official Gazette and made available on the Sinir website, with the necessary documentation for accreditation sent to the Ministry of the Environment and Climate Change within the established deadlines, with no submissions allowed outside the specified period.

The purpose of the ordinances is to ensure the continued structuring of the reverse logistics system and the fulfillment of national goals, strengthening the circular economy and the proper management of electronic waste and packaging. The new regulations came into force after their publication.
