PROCON -SP creates “Verified Company” and “Efficiency” stamps

The Foundation for Consumer Protection and Defense of the State of São Paulo – PROCON/SP issued Normative Ordinances No. 054 and 055, published on 24 March 2022, creating the “Verified Company” and “Efficiency” stamps.

According to Ordinance No. 54, the “Verified Company” stamp aims to inform consumers that the supplier is registered in the PROCON-SP DIGITAL system. It will be available to all suppliers of products and services that have digital certification. The stamp must have an annual validity, the institutional image of PROCON, a mechanism for authentication by the consumer, and the wording “Certification that the above company is registered in the system PROCON-SP DIGITAL. A security service to the consumer”.

For companies with outdated data, the “Verified Company” stamp will be revoked.

According to Ordinance No. 55, the “Efficiency” stamp will be available to large companies that obtain a monthly average resolution factor equal to or greater than 85% in each of the last three auditable semesters in the PROCON-SP system. The stamp must have the supplier’s identification, quarterly validity, PROCON’s institutional image, authentication mechanism by the consumer, and the wording “Certification that the above company has a satisfactory solution index in the complaints registered in the PROCON-SP DIGITAL system”.

The “Efficiency” stamp will be revoked in any of the following situations: (i) when a company obtains resolutivity equal to or lower than 70% in any month; (ii) when a company obtains a weighted average lower than 85% for the previous quarter; (iii) in the case of absence of response to any request for clarification based on art. 39 of Normative Ordinance No. 247/2021; (iv) in the case of registration data being outdated; and (v) in a situation of serious violation of consumer rights, by decision of the Director of Customer Service and Consumer Guidance.

Both stamps can be used in all of the company’s advertising material and may be obtained through a form available in the supplier’s space in the PROCON-SP DIGITAL system.
