Brazil: Antidumping sunset review of disposable syringes
In brief
Pursuant to a determination by SECEX[1], the sunset review was initiated of the antidumping measure applied to Brazilian imports of disposable general-use syringes, made of plastic, with capacities of 1 ml, 3 ml, 5 ml, 10 ml or 20 ml, with or without needles, classified under subheadings 9018.31.11 and 9018.31.19 of the Mercosur Common Nomenclature (NCM), originating in China, with the purpose of evaluating the likelihood of continuation or recurrence of dumping and the resulting injury to the domestic industry.
The investigation may result in the extension of the antidumping duty for five years, keeping the cost of Brazilian imports of the product under investigation at higher levels.
The Importance of stakeholder participation
The active participation of importers, exporters, and any other interested parties in the investigation may be decisive in ensuring a final determination that is more favorable to the interested party concerned. Interested parties may request admission to the proceedings by July 10, 2026[2], provided they demonstrate the extent to which they may be affected by the possible extension of the duty.
- Deadline for replying to the Importer’s Questionnaire: 30 days as of acknowledgment of receipt (presumed to be 3 days after the date of electronic transmission by the authority);
- Deadline for replying to the Exporter’s Questionnaire: 30 days as of acknowledgment of receipt (presumed to be 7 days after the date of electronic transmission by the authority).
As a general rule, a public interest assessment may only be requested after the conclusion of the trade remedies investigation, as established by SECEX Ordinance No. 282/2023.
