New program for payment of ICMS debts in São Paulo

On November 5, 2019 it was published Decree No. 64.564 of São Paulo State, providing for the Special Program for Installment Payment (“PEP”) related to the Tax on Circulation of Goods and Telecom and Freight Services (“ICMS”) for debts constituted or not, whether enrolled or not in the tax attorney’s debt list.
The program waives the payment of interest, punitive and late payment fines in the settlement of ICM and ICMS-related tax debts arising from taxable events occurring up to May 31, 2019.
Consolidated program debts may be paid:
• In a single installment, with a reduction of up to 75% of punitive and late payment fines and up to 60% of other legal additions;
• In up to 60 consecutive monthly installments, with a reduction of 50% of the updated value of the punitive and late payment fines and 40% of the interest on the tax and the fine;
• Up to 12, 30 or 60 installments
The taxpayer may join the PEP from November 7, 2019, to December 15, 2019, by accessing the website: www.pepdoicms.sp.gov.br, to select the tax debts to be paid and issue GARE- ICMS corresponding to the first installment or the single installment.
The first installment or single installment should be paid:
November 25, for the adhesions, occurred between November 7 and November 15, 2019;
December 10 for the adhesions occurred between November 16 and 30, 2019;
December 20 for the adhesions occurred between December 1st and 15th, 2019.
