STATE DECREE (SP) No. 66,575, OF MARCH 17, 2022 – Amends and revokes Decree no. 66,554, of March 9, 2022, regarding the use of masks in the State of São Paulo

On March 17, 2022, was published the State Decree (SP) n. 66.575, which deals with the mandatory use of masks in the state. In summary, the decree provides for the mandatory use of face protection masks only (i) in places intended for the provision of health services and (ii) in means of collective passenger transport and respective places of access, departure and arrival.

The decree issued by the Government of the State of São Paulo on the use of masks only in closed environments with public access, does not revoke the restrictions provided for in other rules, especially those provided for in the Federal Law that regulates measures to cope COVID-19. 19 (art. 3, item III-A and art. 3-A, of Law No. 13.979/2020), which requires the use of face masks in “commercial/industrial establishments and other closed places where people gather” .
In this sense, taking into account that (i) the end of the pandemic has not yet been decreed; (ii) COVID-19 can be considered an occupational disease and (iii) ordinance 20/20 of the Ministry of Labor jointky with the Ministry of Health, which specifically deals with the work environment, is still in force, it is recommended that companies carefully evaluate the internal measures to be adopted to release, or not, the use of face masks on their premises.
