Valor Econômico features article by Trench Rossi specialists on succession disputes and arbitration
In an article published by Valor Econômico, partners Fernanda Haddad and Giuliana Schunck, together with associate Maria Clara Andrade, from our Wealth Management and Family Law practice, analyze the recent decision by Brazil’s National Justice Council (CNJ) recognizing the possibility of registering probate proceedings and asset divisions carried out through arbitral awards.
According to the authors, the decision reinforces the effectiveness of arbitration in succession-related disputes by limiting registrars’ role to the formal review of documents, without reassessing the merits of the award. They highlight that the ruling marks an important step toward consolidating arbitration as an efficient and specialized mechanism for resolving inheritance and asset division matters, while preserving the parties’ autonomy.
