Brazil: Anti-dumping investigation ref. lactic acid

In brief

By determination of SECEX, an antidumping investigation was initiated on Brazilian imports of lactic acid and its salts (NCM 2918.11.00) originating in China.

The product object of the investigation consists of “lactic acid and its salts”, including lactic acid (C₃H₆O₃) and acid salts (lactates), including: sodium lactate(C₃H₅NaO₃; CAS 72-17-3), potassium lactate(C₃H₅KO₃; CAS 996-31-6), calcium lactate(C₆H₁₀CaO₆; CAS 814-80-2) and other metallic lactates, such as magnesium, zinc and iron.

The product is used as a preservative, pH regulator and antimicrobial agent in the food, pharmaceutical, cosmetic and chemical industries.

The investigation may result in the imposition of antidumping duties for a period of five years, extendable.

The importance of stakeholder participation 

The active involvement of importers, exporters and any other interested parties in the investigation may be decisive in ensuring a final determination that is more favourable to the interested party concerned. Interested parties may request their admission to the process until July 17, 2026*, provided that they demonstrate the degree to which they may be affected by the eventual extension of the right.

  • Deadline for responding to the Importer’s Questionnaire: 30 days from the acknowledgment of receipt (presumed to be 3 days after the date of electronic transmission by the authority);
  • Deadline for responding to the Exporter’s Questionnaire: 30 days from the acknowledgment of receipt (presumed to be 7 days after the date of electronic transmission by the authority).

As a rule, the public interest assessment can only be requested after the conclusion of the trade defense investigation, as established by SECEX Ordinance No. 282/2023.
