BRAZILIAN GENERAL CONTROLLER´S OFFICE (CGU) APPLIES SANCTIONS BASED ON ANTI-CORRUPTION LEGISLATION TO TELECOMMUNICATION AND FOOD SECTORS COMPANIES

Two decisions issued in administrative accountability procedure, conducted by the General Controller´s Office (“CGU”), were published in the Official Gazette this Friday (10/16/2020)due to violation of the Brazilian Anti-Corruption Law.
 
1 – Food Company
 
Sanctions: fine of R$ 442,690.00 corresponding to 0.1% (one tenth percent) of the company’s gross revenue in 2017 Reduced fine: authority took into account the voluntariness of the company expressed through a self-report, a fact that deserves to be highlighted and which reflects the relevance of the companies’ compliance program as an evaluation criterion by the authorities for purposes mitigation of monetary sanction
extraordinary publication of the sanctioning administrative decision

 Conduct: the company would have “on several occasions given undue advantages, in cash and food, to federal public officials of the Federal Agriculture Department, Livestock and Supply (“MAPA”) designated to inspect its facilities in Balsa Nova and Ponta Grossa” both cities in the state of Paraná, in the southern region of the country.

 2 – Telecom Company
 
Sanctions: fine of R$ 45,747,320.64 corresponding to 0.1% (one tenth percent) of the company’s gross revenue in 2018
extraordinary publication of the sanctioning administrative decision
 
Conduct: the company would have distributed tickets for the 2014 World Cup to public officials.

 Thus, the imposition of such sanction reinforce:

(i) the enforcement actions of CGU for violations of the Brazilian Anticorruption Law and
(ii) importance on the necessary care in the relationship with public officials and the officering of anything of value.
