Implementation of paragraph 39 of Annex 18-A of the Trade and Sustainable Development Chapter

The Brazilian Secretariat of Foreign Trade (SECEX) has launched a public consultation regarding the implementation of Paragraph 39 of Annex 18-A, which relates to the Trade and Sustainable Development Chapter of the Mercosur-European Union Agreement. The provision calls for the development of a list of products from Mercosur signatory countries that contribute to the conservation, restoration, sustainable use, and management of forests and vulnerable ecosystems and that may be granted preferential or additional access to the European Union market or other trade incentives.
Interested parties may submit comments from 3 August to 2 September 2026 through the electronic form available on the Brasil Participativo platform.

The commitment set forth in paragraph 39
Paragraph 39 of Annex 18-A provides that, within one year of the entry into force of the Agreement, the Parties shall establish a list of products originating in the Mercosur signatory States that contribute to the conservation, restoration, sustainable use, and stewardship of forests and vulnerable ecosystems.
Products included in the list, which is to be reviewed every three years, shall benefit from preferential or enhanced access to the European Union market, as well as from other trade-promoting incentives, including technical assistance and capacity-building initiatives.
In this context, the public consultation offers companies, industry associations, and other stakeholders an opportunity to identify Brazilian products that should be considered for inclusion in the list and to submit information demonstrating their contribution to the environmental objectives set out in the Agreement. Participants may also propose incentives deemed relevant to fostering trade in such products within the European market.
The Importance of Stakeholder Participation
The public consultation will enable citizens, companies, trade associations, professional organizations, federations, confederations, consumer associations, non-governmental organizations, members of the academic community, representatives of state, municipal, and district governments, as well as other interested parties, to provide input to SECEX regarding the implementation of the commitment established under Paragraph 39 of Annex 18-A of the Mercosur-European Union Agreement.
- Submission period: 3 August 2026 to 2 September 2026.
- Participation mechanism: Electronic form available through the “Brasil Participativo” platform.
- Supporting materials: Supplementary documents and supporting materials may be submitted during the consultation period in accordance with the instructions provided in the electronic form.
- Restrictions: Contributions submitted in a format other than that prescribed, as well as submissions containing electoral content, will be automatically disregarded and will not be published.
- Confidentiality: Information submitted may be made publicly available, except when protected under applicable law, in which case it may be disclosed only in aggregated form.
