DG/PF Normative Instruction No. 338/2026 applies to individuals and legal entities that manufacture, import, export, sell, store, transport, or use chemicals that, directly or indirectly, may be used for the illicit manufacture of narcotic substances and that, for this reason, are subject to control by the Federal Police. It consolidates the entire control process within the SIPROQUIM2 system, with authentication via digital certificate or Gov.br account and the use of electronic power of attorney for representatives, as well as the submission of control records.

The aspect that deserves the most attention is the penalty system, which is now detailed and tiered—ranging from a warning to a fine (which can reach R$ 350,000 per violation for the most serious offenses, such as operating without a license or falsifying documents), up to the suspension and revocation of the license. The Normative Instruction also sets forth explicit criteria for determining penalty levels, including aggravating factors (such as obstructing inspections or repeat offenses) and relevant mitigating factors, such as cooperation and the correction of irregularities immediately following notification.
