Initiation of changed circumstances review of the antidumping duty on PET resin imports from China

In brief

Pursuant to a determination by SECEX, a changed circumstances review has been initiated of the anti-dumping duty applicable to Brazilian imports of PET resin with intrinsic viscosity between 0.7 dl/g and 0.88 dl/g, commonly classified under NCM subheadings 3907.61.00 and 3907.69.00, originating in China.

The investigating authority found evidence of a significant and lasting change in circumstances, based on indications that dumping is currently occurring at levels higher than those identified in the most recent review and above the anti-dumping duties currently in force. According to the initiation report, this suggests that the existing measure may no longer be sufficient to offset the effects of dumping.

The authority also considered that structural changes in the global market, including the expansion of Chinese production capacity, the redirection of exports, and the reconfiguration of international trade flows, support the conclusion that such changes are not temporary in nature.

The review may result in an increase of the anti-dumping duty currently in force if it is confirmed that the existing measure has become insufficient to neutralize dumping and its effects. The review is scheduled to be completed within ten months, extendable by an additional two months, while the current anti-dumping duty will remain unchanged throughout the investigation.

The importance of stakeholder participation

Active participation by importers, exporters, and other interested parties may be critical to securing a more favorable outcome in the investigation. Interested parties may request admission to the proceeding until July 7, 2026[1], provided they demonstrate that they may be affected by any modification of the anti-dumping duty.

  • Deadline for Importer Questionnaire responses: 30 days from acknowledgment of receipt (which is presumed to occur 3 days after electronic transmission by the authority).
  • Deadline for Exporter Questionnaire responses: 30 days from acknowledgment of receipt (which is presumed to occur 7 days after electronic transmission by the authority).

As a general rule, a public interest assessment may only be requested after the conclusion of the trade-remedy investigation, as established by SECEX Ordinance No. 282/2023.
