Law 14,533/23 – Ethnical and racial information in the workplace

Law 14,553/23 was published in the Official Gazette of April 24, 2023, amending articles 39 and 49 of Law 12,288/10 (known as the Race Equality Statute) to determine the process and criteria for the collection of information related to ethnical and racial participation in the workplace.

Per the new law, in force since its publication, employer records shall contain specific spaces to identify the racial and ethnical segments that the employees identify themselves, allowing self-declaration for certain determined groups.

The new obligations and the racial and ethnical self-declaration possibility triggers certain legal concerns, not only with respect to the protection of this sensitive data, but also regarding how to address potential conflict arising from the information provided.
